Terms of Use

We reserve the right to update these Terms of Use at any time without notice. By using our services, you agree to review the Terms of Use periodically to remain informed of any changes.

  1. Introduction
    These Terms of Use apply to all users of the BlackOwl GPS Tracking Platform, hardware, and mobile applications. By accessing or using our services, you agree to be bound by these terms.

  2. Definitions
    "BlackOwl" refers to MEO Technologies Pty Ltd trading as BlackOwl GPS.
    "Software" refers to the BlackOwl GPS tracking platform and any related applications or services.
    "Device" means any GPS tracker or accessory supplied by BlackOwl.
    "Client" or "You" refers to any individual or organisation using our hardware, software or services.
    "SIM" refers to the SIM card provided and installed by BlackOwl in your GPS tracking device.

  3. Use of Services

  • You must comply with all local, state, and federal laws relating to surveillance and GPS tracking.

  • You may not use our products or software for unlawful or malicious purposes. Misuse may result in immediate service termination.

  • SIMs remain the property of BlackOwl and are not to be removed, transferred, or used in other devices. Any such misuse will result in service cancellation and liability for all incurred costs.

  • Overseas use of Telstra-based SIMs, used in earlier models of trackers sold prior to 2021, is prohibited without written permission. This limitation does not apply to Teltonika and Digital Matter devices sold from 2021 onwards.

  • Our newer SIMs support international use in up to 220 countries, but coverage depends on device compatibility. We do not guarantee overseas performance.

  1. Account & Subscription

  • Access to our tracking platform requires a paid subscription.

  • Cancellation requests must be made at least 48 hours prior to the next billing cycle.

  • If cancellation occurs after this period, the next cycle will be charged.

  • Once a subscription is cancelled, the SIM is permanently deactivated. A replacement SIM can be issued for $25, including the first month of service.

  • Services may be paused for up to 6 months. After this period, the SIM will be cancelled and a new one must be purchased.

  1. Leases

  • Clients who lease tracking equipment from BlackOwl must also agree to the terms outlined in the Lease Agreement available at: https://www.blackowlgps.com.au/pages/fleet-tracking-lease-agreement.

  • These Terms of Use apply in conjunction with the Lease Agreement. In the event of a conflict, the Lease Agreement will take precedence for lease-related matters.

  1. Software & Server Availability

  • We aim for >99.5% uptime.

  • Scheduled maintenance occurs between 12am–4am (AEST) to minimise disruption.

  • Notice of extended outages will be provided at least 7 days in advance.

  • BlackOwl is not liable for downtime, service disruptions, or loss of data.

  1. Data, Privacy & Disclosure

  • Tracking history is stored for up to 12 months.

  • We do not sell or share your personal or tracking data. Limited, temporary access may be provided to trusted operational partners where necessary.

  • We may disclose account or tracking data to law enforcement or regulatory bodies if legally required.

  1. Limitation of Liability & Indemnity

  • You acknowledge that GPS tracking is a supplementary tool and does not guarantee recovery of stolen vehicles/assets.

  • You must maintain adequate insurance and security measures.

  • Tracking performance may vary depending on geographic location, available network signal, environmental conditions, or hardware limitations. Real-time tracking relies on active network connectivity and a functioning device.

  • It is the Client’s responsibility to confirm proper operation of the device following installation, service resumption, or any system updates.

  • We are not liable for any loss or damage due to:

    • Theft, damage or unauthorised access

    • Device malfunction or SIM/network failure

    • Software or server downtime

    • Incorrect or delayed location updates

  • We explicitly exclude all liability for consequential, incidental, or indirect damages, including but not limited to lost business, lost income, loss of opportunity, or reputational harm.

  • Our liability, if any, is limited to the value of your remaining subscription balance.

  • This clause applies to all components of our service, including hardware, software, firmware, and third-party integrations.

  1. Intellectual Property

  • All intellectual property in our software, hardware, and website belongs to BlackOwl.

  • You may not copy, resell or modify any part of our platform or devices.

  • Data uploaded to the platform remains your property, but you must keep your own backups.

  1. Termination
    We reserve the right to suspend or terminate services without notice if:

  • You breach any of these Terms

  • Misuse of hardware, software, or data occurs

  • Your subscription lapses beyond the allowed pause period

  1. Entire Agreement
    These Terms constitute the full agreement between you and BlackOwl and supersede any prior communications.

  2. Governing Law
    These Terms are governed by the laws of the State of Victoria, Australia. Any disputes must be resolved in Victorian courts.
