This Privacy Policy applies to our website, GPS tracking hardware, tracking platform, mobile applications, SIM services, subscriptions, support and related services.

We do not sell personal information or tracking data. Tracking and account information may be accessed by BlackOwl GPS and trusted service providers where reasonably necessary to provide, support, secure, maintain or improve our services.

Our tracking platform is hosted and operated using trusted third-party platform, cloud, infrastructure and support providers.

  • support requests, warranty requests, installation information and service notes;
  • website usage data, cookies, analytics data and online interaction data;
  • any other information you provide to us directly or indirectly.
3. Tracking Data and Location Information

Our services involve the collection and processing of GPS tracking data. This may include location history, route history, speed, movement events, ignition status, geofence events, alert records, timestamps, device status and other information generated by a GPS tracking device or tracking platform.

Tracking data may be Personal Information where it identifies, relates to or can reasonably be linked to an individual, such as a driver, employee, contractor, customer, family member or asset user.

You are responsible for ensuring that you have the legal right, authority and consent required to install, activate, access or monitor any tracker or tracked asset. This includes ensuring that any affected drivers, employees, contractors, customers, family members or other persons are properly notified and, where required, have given valid consent.

4. How We Collect Personal Information

We may collect Personal Information:

  • when you visit our website or submit an enquiry form;
  • when you purchase, lease, activate or use a GPS tracker;
  • when you create, access or use a tracking account;
  • when a tracking device sends location, diagnostic or event data to the tracking platform;
  • when you contact us by phone, email, live chat, SMS, form submission or social media;
  • when you subscribe, cancel, reactivate, pause or modify a service;
  • when you request support, warranty help, technical assistance or installation guidance;
  • from payment processors, subscription platforms, shipping providers, device suppliers, SIM providers, tracking platform providers and other service providers;

5. Why We Collect and Use Personal Information

We collect and use Personal Information for purposes including:

  • providing GPS tracking hardware, software, subscriptions, SIM connectivity and support;
  • creating and managing tracking accounts;
  • processing orders, invoices, payments, renewals, cancellations and reactivations;
  • activating, configuring, monitoring, troubleshooting and supporting GPS tracking devices;
  • displaying tracking data, alerts, reports, history and related platform features;
  • responding to enquiries, support requests, complaints and warranty matters;
  • communicating service updates, subscription information, technical notices and important account information;
  • improving our products, services, website, support processes and customer experience;

9. Overseas Hosting and Cross-Border Disclosure

Our tracking platform is hosted and operated using trusted third-party platform, cloud, infrastructure and support providers. Depending on the systems, infrastructure and support arrangements used to provide the service, Personal Information and tracking data may be stored, processed, accessed or backed up outside Australia.

Some of our platform and infrastructure providers may maintain recognised information security certifications or controls. These certifications and controls assist with information security management, but they do not guarantee that data will always be stored in Australia, that a security incident can never occur, or that access to the platform will be uninterrupted.

By using our services, you acknowledge that Personal Information and tracking data may be disclosed to, stored by or processed by service providers located outside Australia. We take reasonable steps to use reputable service providers and to protect Personal Information in accordance with this Privacy Policy and applicable law.

10. Security of Personal Information

We take reasonable steps to protect Personal Information from misuse, interference, loss, unauthorised access, modification and disclosure.

Security measures may include account access controls, password protection, platform permissions, limited staff access, supplier controls, secure payment processing, technical safeguards, monitoring, support procedures and use of reputable service providers.

No method of transmission, hosting, storage or electronic communication is completely secure. We cannot guarantee that Personal Information or tracking data will be immune from cyber incidents, unauthorised access, service outages, technical faults or data loss.

You are responsible for keeping your account login details secure, using strong passwords, limiting account access to authorised users, promptly removing users who no longer require access and notifying us if you suspect unauthorised access or misuse.

11. Stored Tracking History and Data Retention

Tracking history is generally stored for up to 12 months, although retention periods may vary depending on platform settings, subscription status, service type, technical limitations, system changes, trial account arrangements or operational requirements.

For trial or demo accounts, tracking data may be deleted after the trial is complete and all sample trackers are returned.

We may retain account, billing, transaction, support, warranty, tax, legal, compliance, dispute and business records for as long as reasonably required for the purposes described in this Privacy Policy or as required by law.

After cancellation, suspension or termination of services, access to tracking data may be removed. You are responsible for exporting any required reports, records or tracking history before cancellation where the platform provides that option.

12. Sensitive Information

Sensitive information is defined in the Privacy Act to include information or an opinion about matters such as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us only:

  • for the primary purpose for which it was obtained;
  • for a secondary purpose that is directly related to the primary purpose;
  • with your consent;
  • where required or authorised by law.
13. Access to Your Personal Information

You may request access to Personal Information we hold about you or ask us to correct Personal Information that is inaccurate, incomplete or out of date.

We may need to verify your identity before responding to a request. In some cases, we may refuse access or correction where permitted by law, such as where disclosure would affect another person’s privacy, reveal commercially sensitive information, prejudice an investigation or be unlawful.

BlackOwl GPS will not charge a fee for making an access request, but may charge a reasonable administrative fee for providing a copy of Personal Information where permitted by law.

14. Maintaining the Quality of Your Personal Information

We take reasonable steps to ensure that Personal Information we hold is accurate, complete and up to date.

If you find that information we hold is incorrect, incomplete or out of date, please advise us as soon as practicable so we can update our records and continue to provide services to you.

15. Account Users, Businesses and Fleet Customers

Where services are supplied to a business, fleet, organisation or account administrator, that customer may control which users have access to tracking data, reports, alerts, driver information, vehicle information and account settings.

The account owner or administrator is responsible for managing authorised users, setting permissions, removing access when no longer required and ensuring that use of the tracking platform complies with privacy, surveillance, workplace and employment laws.

16. Law Enforcement, Emergencies and Legal Requests

We may disclose Personal Information, tracking data or account information where required or permitted by law, including in response to lawful requests from police, courts, regulators, emergency services or other authorities.

We may also disclose information where reasonably necessary to protect life, health, safety, property, legal rights, security or to investigate unlawful activity, unauthorised tracking, fraud, misuse, cyber incidents or breaches of our Terms of Use.

17. Data Breaches

If we become aware of a data breach involving Personal Information, we will assess the incident and take reasonable steps to contain, investigate and respond to it.

Where required by applicable law, we will notify affected individuals and the Office of the Australian Information Commissioner or other relevant authority.

Our services are intended for lawful GPS tracking of vehicles, assets, equipment and other approved use cases. They must not be used for unlawful, unsafe, stalking, harassment, covert or unauthorised tracking.
